Terms and Conditions

These terms govern access to FAMANTY and the use of its marketplace by buyers, producers and shops. They are intended to explain clearly who sells, what the platform does, and the rules that protect all participants.

1. Operator and scope

FAMANTY is operated by famanty.com (the “Platform”, “FAMANTY”, “we” or “us”). These terms apply whenever you visit, register, list a product, place or manage an order, send a message, review a product, or use a courier integration.

By using FAMANTY you confirm that you have read and accepted these terms. If you act for a business, you confirm that you may bind it. Mandatory consumer rights always prevail over conflicting provisions in these terms.

2. The marketplace and the seller

FAMANTY provides the technical marketplace. Unless an order screen expressly says otherwise, the producer or shop identified in the product listing is the seller and the contract for the goods is between that seller and the buyer. FAMANTY is not the producer, owner or reseller of those goods and does not take possession of them.

Each seller controls its listings, availability, price, taxes, acceptance of orders, preparation, delivery options, returns and after-sales support. FAMANTY may facilitate communication, order records and courier-label creation, but is not a carrier and does not guarantee a carrier’s performance.

3. Accounts and eligibility

  • You must provide accurate, current information and keep access to your email account secure. You are responsible for activity performed through your account unless you promptly report unauthorised use.
  • Buyers must have legal capacity to conclude the purchase. A minor may use the service only with the involvement and consent of a parent or guardian where required by law.
  • Professional sellers must provide complete and verifiable trader identity and contact information, required registrations and permits, and promptly update any change.
  • Courier credentials belong to the seller. The seller authorises their use only to request the selected carrier services and must disconnect or rotate compromised credentials.

4. Seller obligations and food information

  • Sellers may offer only lawful, safe and accurately described products they are entitled to sell and must comply with food safety, hygiene, labelling, traceability, tax and consumer-protection rules.
  • Listings must disclose the actual price and quantity, ingredients, allergens, origin and storage/use information whenever legally required or relevant to safe use. Photos must not materially mislead.
  • Sellers are responsible for stock, suitable packaging, temperature control, use-by dates, fulfilment and responding to complaints or recalls.
  • Sellers must not manipulate reviews, move a buyer off-platform to evade safeguards, infringe intellectual property, sell prohibited goods or submit false trader information.

5. Orders, prices and payment

An order is a buyer’s request to purchase at the total displayed before confirmation. Where the cart contains different producers, each producer’s part is a separate order and may be accepted, fulfilled, delivered or cancelled independently. The sale contract is formed when the relevant seller accepts or confirms its part of the order, unless mandatory law provides otherwise.

Prices, delivery charges and any cash-on-delivery amount shown at checkout are provided for confirmation before ordering. The seller must correct obvious pricing or availability errors promptly and may not replace a product without the buyer’s agreement. Unless a payment service is explicitly offered, payment is arranged directly with the seller or carrier and FAMANTY does not hold buyer funds.

6. Delivery, collection and risk

The buyer must provide a complete recipient name, telephone number and delivery address and be available to receive or collect the goods. Delivery dates are estimates unless the seller expressly agrees a binding date. The seller remains responsible for choosing suitable packing and handing the correct shipment to the carrier.

Tracking links and labels are generated from carrier data. Availability, status and accuracy depend on Econt, Speedy or another selected carrier and are governed by that carrier’s terms. Questions about missing, damaged or delayed goods should first be raised with the seller, who remains the buyer’s contractual contact.

7. Cancellation, withdrawal, defects and refunds

Consumers may cancel before acceptance where the interface permits or by contacting the seller. Statutory withdrawal rights apply when their legal conditions are met. The 14-day distance-selling right may not apply to goods liable to deteriorate or expire rapidly, sealed goods unsuitable for return for health or hygiene reasons once unsealed, or personalised goods. The seller must assess the actual product and circumstances; this clause does not remove rights for defective, unsafe, misdescribed or undelivered goods.

Refunds, replacement, price reduction, repair where meaningful, and complaint handling are the seller’s responsibility under applicable law. FAMANTY may provide records or communication tools but does not decide statutory claims. Nothing here limits a consumer’s rights under Bulgarian or EU law.

8. User content and communication

You retain ownership of listings, photos, reviews and other content you submit. You grant FAMANTY a non-exclusive, worldwide, royalty-free licence for the period the content is hosted to store, reproduce, format and display it solely to operate, secure and promote the marketplace and its listings.

Content and messages must be truthful, relevant and lawful and must not be threatening, discriminatory, deceptive, defamatory, privacy-invasive, infringing or spam. We may restrict or remove content when reasonably necessary, explain the reason where required, and preserve evidence where the law requires it. Reports of illegal products or content may be sent to contact@famanty.com with the URL, reasons and supporting evidence.

9. Platform integrity and enforcement

We may verify seller information, request supporting documents, warn users, limit visibility, pause listings, suspend an account or cancel platform access where reasonably necessary for safety, suspected fraud, illegality, repeated non-performance, breach of these terms or legal compliance. Where required, we will give reasons and access to available complaint channels.

Users must not scrape or reverse engineer the service, bypass access controls, introduce malware, overload the service, create false accounts, misuse personal data, interfere with another user, or use the Platform for unlawful activity.

10. Intellectual property

The FAMANTY name, design, software and original platform materials belong to the operator or its licensors. These terms give only a limited, revocable, non-transferable right to use the Platform for its intended purpose. Third-party trademarks, including courier marks, remain the property of their owners and are shown only to identify integrations.

11. Availability, warranties and liability

We aim to keep FAMANTY accurate and available but do not promise uninterrupted operation or that every listing, seller statement, map result, courier response or third-party service is error-free. Users should independently check allergen, safety and time-sensitive information with the seller.

To the maximum extent permitted by law, FAMANTY is responsible only for direct and foreseeable loss caused by its own breach and is not responsible for a seller’s goods, food preparation, non-delivery, user content, carrier conduct or indirect business loss. No exclusion applies to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, data-protection liability, or any liability or consumer remedy that law does not permit us to exclude or limit.

12. Changes, termination and continuity

You may stop using the Platform and request account deletion at any time, subject to records we must retain. We may change these terms for legal, security or functional reasons. Material changes will be announced in the Platform or by email with reasonable notice where practicable and will apply prospectively. Existing accepted orders remain governed by the terms and mandatory law applicable when they were placed.

13. Law, complaints and disputes

These terms are governed by Bulgarian law. If you are a consumer, this choice does not deprive you of mandatory protection or the courts available under the law of your habitual residence. Please first contact the seller for a product or order complaint and contact FAMANTY for a platform complaint. The parties should try to resolve disputes in good faith; consumers may also use the competent Bulgarian consumer-protection authority or another legally available alternative dispute-resolution body and may bring proceedings before a competent court.
